This matter is taken up through hybrid mode.

The petitioner has filed this writ petition seeking to quash the police order no.302/10 under Annexure-3 and further seeks direction to the opposite parties to consider his case for promotion to the rank of Havildar.

Mr. M. Balabantaray, learned Standing Counsel contended that during pendency of the writ petition the petitioner has already got promotion. Thereby, by efflux of time, the writ petition has become infructuous. 4.

Having heard learned counsel for the parties and after going through the records, it appears that during course of 21st batch of DIC training, the petitioner had filed this writ petition apprehending that he might not get promotion, if the last three years eligibility criteria would not be lifted by the Government. But Government was pleased to reduce the eligibility criteria to one year vide Home Deptt. resolution dated 28.12.2010 and, as such, the petitioner has already

promoted during the year 2010.

In the above view of the matter, the writ petition has become infructuous. Accordingly, the writ petition stands disposed of.
