This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.515 of 2022, pending in the file of the learned J.M.F.C., Barbil, arising out of Joda P.S. Case No.178 of 2022, for alleged commission of offences under Sections 397/394 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Champua, by order dated 05.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 15.07.2022 and charge-sheet has already been filed, hence further continuance of the petitioner in custody is unwarranted.

Learned counsel for the State opposes the prayer for bail keeping in view the criminal antecedent of the petitioner. 7.

Taking into account the nature of allegations and filing of charge-sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.

Keeping in view the criminal proclivity of the petitioner, it is directed that the petitioner shall appear before the jurisdictional police station once every 15 (fifteen) days, on such date and time to be fixed by the learned Court in seisin over the matter, till the conclusion of trial.

Accordingly, the BLAPL stands disposed of.
