This matter is taken up through hybrid mode.

The Petitioner being in custody in C.T. Case No.32 of 2019, arising out of Kakiriguma P.S. Case No.47 of 2015, pending in the court of Additional Sessions Judge, Koraput, has filed this petition for his release on bail. The offence alleged against him is punishable under Section 302 read with Section 34 of the I.P.C.

Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party. 4.

Considering the facts and submissions made, though this Court is not inclined to release the Petitioner on bail, but

// 2 // taking note of the fact that material witnesses in this case have already been examined and the Petitioner is in custody more than three years and also there being least chance of his absconding, if released on bail, this Court dispose of this bail application with the order that the Petitioner be released on interim bail for a period of 90 days from the date of his release in the aforesaid case by the Court in seisin over the matter or till disposal of the aforesaid case by the trial court, whichever is earlier, on such terms and conditions as the trial court may deem it just and proper including the condition that the Petitioner shall appear before the trial court on the date of trial, violation of such conditions shall entail cancellation of bail. However, the Petitioner may surrender to custody within 91st day of his release.
