This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.341 of 2022, pending in the file of learned J.M.F.C., Jajpur Road, arising out of Tamaka P.S. Case No.33 of 2022, offence under Sections 489(A)/302/304(B)/34 of IPC and Section 4 of D.P. Act and is in custody since 22.03.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Distr and Sessions Judge, Jajpur Road by order dated 09.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that though the petitioner is forwarded inter alia under Section 302 of IPC and other allied offences, after investigation charge sheet has been filed under

Section 498A/304B/306 of IPC and it is submitted that the motherin-law has been released on anticipatory by this Court by order dated 13.09.2022 un ABLAPL No.7358 of 2022.

Considering the role ascribed to the present petitioner and that he is the father-in-law and charge sheet has been filed under Section 306 of IPC as noted and keeping in view the age of the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
