Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 08.11.2021 in connection with R. Udayagiri P.S. Case No.140 of 2021 corresponding to G.R. Case No.113 of 2021 pending in the Court of learned Special Judge-cum-Additional Sessions Judge, Parlakhemundi, Gajapati for the alleged commission of offence under Sections 20(b)(ii)(C)/29 of N.D.P.S. Act.

The petitioner's earlier bail application was rejected by this Court as per order passed in BLAPL No. 2380 of 2022. It is submitted that trial has already begun with 16 out of 20 witnesses being already examined. Since trial is nearing completion, I am not inclined to grant regular bail to the petitioner but considering his detention for more than a year, the bail application is disposed of with a direction to learned court below to release the petitioner on interim bail for a period of four weeks from the date of his Page No.1 of 1
actual release on such terms and conditions as he may deem fit and proper to impose.

Learned court below is further directed to conclude the trial preferably within a period of two months.

BLAPL is accordingly disposed of.
