This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T. Case No.772 of 2022 pending in the file of learned S.D.J.M., Bhawanipatna, arising out of Bhawanipatna Sadar P.S. Case No.263 of 2022 for offences under Sections 419/420/465/466/468/470/471/120-B/34 IPC and is in custody since 06.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Bhawanipatna by order dated 05.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the Petitioner that the co-accused have already been released on bail by this Court in BLAPL No.7711 of 2022 by order dated 29.08.2022. It is further submitted that allegation against the present Petitioner is that he impersonating himself to be the Informant sold the land in question. 7.

Taking into account the release of the co-accused and the age of the present Petitioner, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
