This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with G.R. Case No. 190 of 2020 corresponding to Sohela P.S. Case No. 52 of 2020, pending on the file of the learned Additional Sessions Judge, Padampur arising out of C.T. Case No. 26 of 2020 for the alleged commission of offence under Section-302, of the IPC and he is in custody since 03.05.2020.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned Additional Sessions Judge, Padampur by Order dtd. 24.09.2020 in B.A. No. 200 of 2020, the present BLAPL has been filed.

Heard Mr. B.B. Routray, learned counsel for the petitioner and Mr. P.Mohapatra, learned Additional Standing Counsel for the State.

Perused the 164 Cr.P.C. statement of one Dharamgiri Goswami @ Kalu who is stated to be an eye witness. . 6.

Taking into account, the genesis of the offence and the age of the accused, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter, so as to ensure that his presence in Court on each date of trial..
