This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.610 of 2022 pending in the file of learned S.D.J.M, Kamakshyanagar, arising out of Tumusingha P.S. Case No.194 of 2022, offence under Sections 341/294/323/354/307/332/506/451/109 IPC and is in custody since 07.09.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C.
by the learned Addl.
Sessions Judge, Kamakhyanagar by order dated 14.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the FIR and the order of rejection.

It is submitted by the learned counsel for the Petitioner that the specific overt act of assault by thenga was attributed to one Latip Sahoo, who has since been released on anticipatory bail by this Court by order dated 13.09.2022 in ABLAPL No.11013 of 2022 and subsequent rejection of anticipatory bail of the present Petitioner, he was taken into custody.

Considering the nature of allegation and this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. Additionally it is directed that the Petitioner shall appear before the I.O once every week till conclusion of the investigation.

Accordingly, the BLAPL stands disposed of.
