This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.918 of 2022 pending in the file of learned J.M.F.C (C), Cuttack, arising out of Mangalabag P.S. Case No.170 of 2022, offence under Section 379 IPC and is in custody since 01.08.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional Sessions Judge, Cuttack by order dated 9.9.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking note of the nature of allegation and the punishment prescribed, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Considering the criminal proclivity of the Petitioner, it is directed that the Petitioner shall appear before the I.I.C., Patkura Police Station once every week till end of January, 2023 and the certification of such appearance shall be submitted to the court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
