IN THE HIGH COURT OF ORISSA AT CUTTACK
ABLAPL No.11967 of 2022 Raghab Jena @ Biswanath Jena ....
Petitioner Mr. G.R. Dhal, Advocate -versusState of Odisha ....
Opp. Party Mr. Arupananda Das, Addl. Government Advocate
CORAM:
JUSTICE S.K. SAHOO Order No.
ORDER
27.10.2022 01.
This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with C.T. Case No.2054 of 2022 arising out of Laxmisagar P.S. Case No.137 of 2022 pending in the Court of learned S.D.J.M., Bhubaneswar for alleged commission of offences under sections 272/273 of the Indian Penal Code and section 52(a) of the Odisha Excise Act.
Perused the F.I.R.
The earlier anticipatory bail application of the
// 2 // petitioner in ABLAPL No.6334 of 2022 was rejected as per order dated 13.07.2022 taking into account six numbers of criminal antecedents and the petitioner was asked to surrender in the Court below and move for bail so that the learned Courts below shall dispose of the same expeditiously.
Without complying the said order, again the anticipatory bail application is filed. I am not inclined to entertain the anticipatory bail application. Accordingly, the ABLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
( S.K. Sahoo) Judge RKM
