This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T. Case No.4975 of 2022 pending in the file of learned S.D.J.M., Bhubaneswar, arising out of Lingaraj P.S. Case No.206 of 2022, offence under Sections 341/427/307/394 IPC and is in custody since 20.08.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Khurda at Bhubaneswar by order dated 14.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection. It reveals that the Informant has sustained simple injury.

It is submitted by the learned counsel for the Petitioner that the investigation has progressed substantially and the Petitioner does not have criminal proclivity.

Taking into account of the same, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. Additionally it is directed that the Petitioner shall appear before the I.O once every week till conclusion of the investigation.

While enlarging the Petitioner on bail, learned court below shall verify the assertion relating to criminal antecedent. In the event it is found that the Petitioner has any criminal antecedent, this order shall stand recalled without further reference to the Court. 9.

Accordingly, the BLAPL stands disposed of.
