This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. 3.

The petitioner is an accused in connection with C.T. Case No.142 of 2022, pending before in the file of the learned NGNcum-J.M.F.C., Bhograi, arising out of Talasari Marine P.S. Case No.19 of 2022, for alleged commission of offences under Sections 498-A/306/304-B/34 of IPC read with Section 4 of the D.P. Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Balasore, by order dated 15.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner is the father-in-law and he is in custody since 10.05.2022 and as charge-sheet has already been filed on

03.09.2022, further continuance of the petitioner in custody is unwarranted.

On perusal of the order sheet of the learned Court in seisin over the matter, it is seen by order dated 05.09.2022, cognizance of offences under Sections 498-A/306/304-B/34 of IPC read with Section 4 of the D.P. Act., has been taken against the present petitioner and his wife.

Considering the same and taking into account the allegations qua the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
