This matter is taken up through Hybrid Mode.

Heard Mr. S.K. Gartia, learned counsel for the petitioner and Mr. Choudhury S. Mishra, learned A.G.A. 3.

It is submitted that the petitioner though discharging his duties as a Jr. Revenue Asst. in the establishment of Sub-Collector, Padampur, DistBargarh-Opp. party No.4, but he has not been paid with the salary from August, 2022.

On instruction, Mr.

Mishra, learned AGA submitted that since no instruction has been provided by the RDC, Northern Division, Samabalpur, the salary of the petitioner has been temporarily withheld. The aforesaid ground indicated in the instruction provided to the learned AGA by the Sub-Collector vide his letter dated 29.9.2022 is not a good and justifiable ground to withheld the salary of the petitioner.

Therefore, While disposing the writ petition, this Court is of the opinion that if the petitioner is discharging his duties in the establishment of Opp. party No.4, his salary should be paid regularly.

// 2 // Accordingly, opp. party no.4 is directed to release the salary as due and admissible from August, 2022 in favour of petitioner within a period of ten days from the date of receipt of this order, if there is no other legal impediment.

The Writ Petition is disposed of with the aforesaid observation and direction.
