This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.376 of 2022, pending in the Court of learned S.D.J.M. Paralakhemundi, arising out of Paralakhemundi P.S. Case No.157 of 2022, for alleged commission of offences under Sections 457/380 of I.P.C.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Gajapati by order dated 06.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is borne out from the order of rejection that the implication of the Petitioner was on account of co-accused statement.

Taking note of the same and that the Petitioner is in custody since 11.08.2022 and investigation has progressed substantially, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

It is stated in the order of rejection that the Petitioner has criminal antecedent. Hence, it is directed that he shall appear before the Investigating Officer once every week till the submission of final form.

Accordingly, the BLAPL stands disposed of.
