This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with T.R. No.41 of 2021, pending in the Court of learned Additional Sessions Judgecum-Special Judge, Gunupur, arising out of Chandrapur P.S. Case No.08 of 2021, for alleged commission of offences under Sections 20(b)(ii)(C)/25/29 of NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge, Gunupur, by order dated 17.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.
This is the second journey of the petitioner to this Court.

By order dated 21.06.2022, this Court considering the role ascribed to the petitioner, who is one of the petitioners in BLAPL No.1712 of 2021, rejected his bail application. 7.
Since there are no change of circumstances and in view of the bar contained under Section 37 of the NDPS Act, this Court is not inclined to consider this bail application at this stage. 8.
Accordingly, the BLAPL stands disposed of.
