This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.732 of 2022, pending in the Court of learned J.M.F.C, Jagannath Prasad, Dist-Ganjam, arising out of Jagannath Prasad P.S. Case No.155 of 2022, for alleged commission of offences under Sections 498-A/304-B/34 of I.P.C read with Section 4 of D.P. Act. 4.
Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Bhanjanagar by order dated 03.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted that though the F.I.R. was loged under Section 498-A/304-B/34 of I.P.C. read with Section 4 of D.P. Act, after conclusion of investigation charge sheet has been filed on
28.06.2022 under Sections 498-A/304-B/306 and 4 D.P. Act. It is further submitted that the Petitioner is the husband and is in custody since 02.06.2022.

Taking into account the filing of charge sheet and period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
