This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.211 of 2022, pending in the Court of learned A.C.J.M.-cumA.S.J, Bhubaneswar, arising out of Mancheswar P.S. Case No.158 of 2021, for alleged commission of offences under Sections 379/511/506/323/307/34 of I.P.C.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned A.C.J.M.-cum-A.S.J, Bhubaneswar by order dated 08.08.2022 in the aforementioned case, the present BLAPL has been filed.

On perusal of the order of rejection, it is seen that the Petitioner was released on bail by the learned 1st Additional Sessions Judge-cum-Special Judge, Vigilance, Bhubaneswar on 27.09.2021 in B.A. No.1918 of 2021 for violation of the
stipulations in the said bail order, the Petitioner was taken into custody pursuant to execution of N.B.W.(A) on 30.07.2022. 6.
It is submitted by learned counsel for the Petitioner that the none appearance on the dates fixed was on account of supervening circumstances and was not willful.

Taking into account such submission, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Taking into account the conduct of the Petitioner, this Court directs him to appear before the Jurisdictional Police Station once a week till conclusion of the trial.

Accordingly, the BLAPL stands disposed of.
