Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to the opposite parties to regularize the service of the petitioner by allowing the scale of Jr. SES for the period he has discharged duty of Trained Graduate Teacher, i.e., from 11.01.1982 till 19.12.1991, and to give all promotional benefit to the petitioner in the Sr. SES scale at least from the date when his juniors have been given promotion to the post of Sr. SES, and to fix up the pension of the petitioner taking into consideration the service rendered by him w.e.f. 11.01.1982 and all financial as well as service benefits, within a stipulated time.

In course of hearing, learned counsel for the petitioner

states that petitioner may be permitted to file a fresh representation before the authority concerned highlighting his grievance and direction may be given to the said authority to consider the same within a stipulated time, to which learned counsel for the State has no objection.

As agreed to by the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition with the direction that in case the petitioner, with regard to the grievance made in this petition, files a fresh comprehensive representation before the authority concerned within 15 days hence, the said authority shall consider and dispose of the same by passing a reasoned and speaking order as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with the certified copy of this order.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
