This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.949 of 2022, pending in the Court of learned S.D.J.M., Deogarh arising out of Barkote P.S. Case No.365 of 2022, for alleged commission of offences under Sections 392/34 of I.P.C. 4.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Asst. Sessions Judge, Deogarh by order dated 14.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 17.08.2022 and as investigation has progressed substantially, further continuance of the petitioner in custody is not warranted.

Learned counsel for the State opposes the prayer for bail inter alia on the ground, referring to the order of rejection that the petitioner has been identified in T.I. Parade. Hence, he ought not to be released on bail at this stage, pending submission of final form. 8.

Considering the nature of accusation and progress of investigation, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Taking into account that the petitioner has been identified in the T.I. Parade, it is directed that petitioner shall appear before the Jurisdictional Police Station twice every week till the submission of final form.

Accordingly, the BLAPL stands disposed of.
