This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.258 of 2022, pending in the Court of learned J.M.F.C., Kantamal arising out of Manamunda P.S. Case No.168 of 2022, for alleged commission of offences under Sections 273/274/275 of IPC and is in custody since 11.09.2022.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Kantamal by order dated 16.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Since the seizure of the 640 numbers of Eskuf cough syrup bottles containing 100 ml. each is admittedly less than the commercial quantity as prescribed, this Court directs the petitioner

to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioner to appear before the Investigating Officer once every week till the submission of final form.

8.

Accordingly, the BLAPL stands disposed of.
