Heard learned counsel appearing for the parties. Order No.2 2.
By producing the certified copy, it has been brought to the notice of this Court by Mr.Pradhan, learned counsel appearing for the opposite party nos.4 and 5 submits that in the meantime the impugned proceeding is already disposed of. So the case is landed in a different cause of action. For the development taking place in the meantime, the writ petition at this stage is not entertainable.

For the development through the competent court directing all the three sons to contribute a sum of Rs.300/- (Rupees three hundred) each for the maintenance of old father and Mr.Pradhan submits that the money being offered the father is not receiving the same. Petitioner himself is present in Court and submits that there is no offering of such amount. This Court directs to clear up the whole arrear in shape of
// 2 // Bank Draft in favour of the petitioner at least within a period of ten days hence. So far as further cause of action is concerned, it may be opened to the petitioner to apply accordingly.

The writ petition stands disposed of.
