The petitioner has filed this writ petition seeking disbursement of 100% family pension in her favour being the 2nd wife of the deceased employee from the date the children of the 1st wife of the deceased employee attained 25 years. She also further seeks for direction to disburse the gratuity along with the interest. 3.

Since there is dispute with regard to the succession of the deceased employee, liberty is granted to the petitioner to seek her remedy before the appropriate forum and after such declaration is made, it will be open to the opposite parties to act in accordance with law.
