Mr. Jena, learned advocate appears on behalf of petitioner and submits, his client is the union. Its members have not got the benefits under Employee's State Insurance. His client made representation dated 29th November, 2021 to opposite party no.1 for taking immediate steps for recovery of contributions with fine/penalty from principal employer (opposite party no.2). He seeks direction in respect thereto.

Mr. Ray, learned advocate appears on behalf of opposite party no.1 and submits, on direction made, the representation will be duly dealt with.

Opposite party no.1 is directed to consider and deal with said representation dated 29th November, 2021. Said opposite party, within three weeks of communication, will either initiate the proceeding against the principal employer or inform petitioner as to why same cannot be done.
