This matter is taken up through hybrid mode.

Since the petitioner claims for escalation bill amount, this Court is not inclined to pass any order at this stage. However, if it is permissible under DTCN, the petitioner may pursue his remedy by filing an application annexing the judgment passed by this Court in All Orissa Contractor's Association, Bhubaneswar v. State of Odisha, 2012(II) OLR 586 before the appropriate authority. In such event, the appropriate authority shall apply his mind and pass appropriate order in accordance with law taking into consideration the ratio decided by this Court in All Orissa Contractor's Association, Bhubaneswar (supra). 3.

With the aforesaid liberty, the writ petition stands disposed of.
