This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner and learned counsel for the State.

It is submitted by learned counsel for the petitioner that out of the alleged amount, the petitioner has refunded Rs.94,069/- to the complainant through her agent i.e. one Subash Kumar Nayak on different dates and he undertakes to deposit a sum of Rs.40,000/- (rupees forty thousand). Hence, modification has been prayed for. 4.

Considering the submissions made by learned counsel for the petitioner, condition with regard to depositing the entire amount as reflected in pargraph-4 of the order dated 24.09.2022 stands modified to the extent that the petitioner shall deposit an amount of Rs.40,000/-(rupees forty thousand) before the learned court below. Rest part of the order shall remain intact.

Four weeks' further time from today is extended for the petitioner to surrender before the learned court below, vide order dated 24.09.2022 passed in ABLAPL No.12086 of 2022, but subject to depositing cost of Rs.500/- (Rupees five hundred) in the Advocates' Welfare Fund of Orissa High Court Bar Association within fifteen days and furnishing money receipt thereof in proof of deposit. 6.

It is made clear that, if the cost is not deposited within the stipulated time, time extended for the petitioner to surrender shall stand revoked automatically.

The I.A. is disposed of accordingly.

Urgent certified copy of this order be granted on proper application.
