This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.73 of 2022, pending in the Court of learned Additional Sessions Judge, Dharamgarh arising out of Kegaon P.S. Case No.159 of 2019, for alleged commission of offences under Sections 341/324/307 of IPC and is in custody since 29.07.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Dharamgarh by order dated 14.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner, that since charge has already been filed, the petitioner may be released on bail.

Learned counsel for the State opposes the prayer for bail inter alia on the ground that the injuries suffered are grievous in nature and the petitioner was an absconder, he ought not to be released on bail at this stage.

Considering the submission and keeping in view the assertions at the bar that the injured has recovered and is leading a normal life, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the jurisdictional police station once every month till the conclusion of trial.

Accordingly, the BLAPL stands disposed of.
