This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.841 of 2022, pending in the Court of learned Additional District & Sessions Judge-cum-Special Judge Court under POCSO act, Koraput arising out of Damanjodi P.S. Case No.76 of 2022, for alleged commission of offences under Sections 363/366/376 of IPC read with Section 4 of the Protection of Children from Sexual offence (POCSO) Act and is in custody since 11.08.2022. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge-cum-Special Court under POCSO Act, Koraput at Jeypore by order dated 12.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim. 6.
Considering the tenor thereof and taking into account the period of custody and substantial progress in investigation, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.
Additionally, it is directed that the petitioner shall appear before the jurisdictional police station once every week till the submission of final form.

Accordingly, the BLAPL stands disposed of.
