Heard Mr. S. Satapathy, learned counsel for the petitioners and Mr. A.K. Nanda, learned Additional Government Advocate.

According to Mr. Satapathy, though award has already been pronounced in L.A. Case No.37 of 2018 in connection with acquisition of the Plot Nos.591, 592, 1226, 1242, 1244 & 1246 pertaining to Khata No.400 under mouza-Dhenka in the district of Keonjhar and total compensation has been quantified at Rs.11,72,370/- however, on account of non-cooperative attitude of some of the legal heirs of the recorded tenants, the compensation has not been paid to the petitioners, who also happen to be the legal heirs of some of the recorded tenants. 3.

During course of hearing, Mr. Satapathy submits that liberty may be granted to the petitioners to move the Collector, Keonjhar (opposite party No.3) in the matter by filing a representation for redressal of their grievances and further

// 2 // prays that the said opposite party be directed to take a decision on such motion within a specific time period. 4.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioners to file individual representations before the Collector, Keonjhar (opposite party No.3) through registered post within a period of two weeks from today. In the event, such representations are filed along with a copy of this order, the opposite party No.3 is directed to take decisions on the same in accordance with law keeping in mind the interest of the legal heirs of the recorded tenants namely, Late Srinibasa Mohanty, Late Harekrushna Mohanty, Late Radhakrushna Mohanty, Late Natabara Mohanty and Late Poka Mohanty within a period of four weeks from the date of receipt of such representations and communicate the result of such exercise to the petitioners.

Accordingly, this writ petition is disposed of. 6.

Urgent certified copy of this order be granted on proper application.
