This matter is taken up through hybrid mode.

The petitioner is not a bidder to the auction notice issued on 26.06.2020 under Annexure-9 to the writ petition. Furthermore, as it appears from the counter affidavit, one Sarat Behera has been declared highest bidder in respect of Kalyanpur-B sand, Smt. Samita Sahoo has been declared as highest bidder for Bhagabatipur Murom Source and Hemant Routray has been declared highest bidder in respect of Haridamada Murom Source and accordingly, they are operating the sources. As such, the petitioner has not impleaded the successful bidders as parties to the writ petition.

In view of such position, the writ petition suffers from nonjoinder of parties. Accordingly, the writ petition merits no consideration and the same is dismissed.
