Heard Mr. M.K. Kanungo, learned Senior Counsel appearing along with Mr. C.K. Nayak, learned counsel for the petitioner; Mr. P.P. Mohanty, learned Additional Government Advocate appearing for the State-opposite party no.1 and Mr. L.N. Rayatsingh, learned counsel appearing for opposite party no.2.

The petitioner has filed this writ petition seeking direction to opposite party no.2 to refund amount deposited by the petitioner immediately in response to Annexure-4. 4.

Since the petitioner claims for refund of amount in view of letter under Annexure-4 dated 18.12.2019, it is open to the petitioner to pursue its remedy before the appropriate

forum in terms of the DTCN/agreement executed between the parties or any other documents, which are applicable to it. 5.

With the aforesaid liberty, the writ petition stands disposed of.
