Mr. Mohapatra, learned senior advocate appears on behalf of petitioner and submits, his client had been declared as selected for award of dealership. However, by impugned annexure-8 (letter dated 9th October, 2019) the oil company rejected his client's candidature on ground that offered land is situated outside advertised location. Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of opposite party no.3.

Mr. Nanda, learned advocate appears on behalf of the oil company and points out that the selection was on draw of lots. The declaration of selection was subject to compliance of terms and conditions of the corporation, being physical verification of offered
// 2 // land. The offered land was found to be outside advertised location. He submits, by impugned letter petitioner's candidature was kept alive for consideration with group-3 applicants.

The oil company will consider petitioner's candidature in terms of impugned annexure-3.

The writ petition is disposed of.
