This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.717 of 2022 pending in the file of learned S.D.J.M., Athamallik, arising out of Thakurgarh P.S. Case No.182 of 2022, for offence under Sections 457/380 IPC and is in custody since 30.08.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. District & Sessions Judge, Athmallik by order dated 14.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the nature of allegation, learned counsel for the Petitioner submits that further continuance of the Petitioner in custody is unwarranted.

Learned counsel for the State opposes the prayer for bail, inter alia, on account of criminal proclivity of the Petitioner as reflected in the case diary as well as in the order of rejection. 8.

Taking into account the nature of accusation, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 9.

Additionally, it is directed that the Petitioner shall appear before the jurisdictional police station of the Court in seisin over the matter once in every 10 days till the conclusion of trial. 10.

Accordingly, the BLAPL stands disposed of.
