This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is an accused in connection with T.R No.360 of 2022, pending in the Court of the learned Special Judgecum-Additional District and Sessions Judge, Bhubaneswar, arising out of Kharbelnagar P.S. Case No.298 of 2022, for commission of offences under Sections 354-D/506/341/354/511/366 of IPC read with Section 8 & 12 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Bhubaneswar, by order dated 15.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the 164 Cr.P.C. statement of the victim.

Considering the age of the petitioner and that on being release on interim bail, the petitioner has not misused the confidence reposed in him, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
