The Petitioner in this CMP seeks to assail the order dated 29th August, 2022 (Annexure-) passed by learned Additional Senior Civil Judge, Baripada in C.S. No.134 of 2017, whereby an application under Order XVIII Rule 4 C.P.C. filed by the PlaintiffOpposite Party to lead evidence has been allowed. 3.

In view of the ratio decided in the case of Janki Vashdeo Bhojwani and another -v- IndusInd Bank Ltd. and others, reported in 2005(2) SCC 217, learned counsel for the Petitioner prays for withdrawal of CMP.

Accordingly, the CMP is disposed of as withdrawn. Urgent certified copy of this order be granted on proper application.
