This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 439 of Cr.P.C. in connection with Borigumma P.S. Case No. 31 of 2020 corresponding to T.R. Case No. 13 of 2020 pending in the Court of learned Sessions Judge -cum- Special Judge, Koraput for offence punishable under section 20(b)(ii)(C) of the N.D.P.S. Act. It appears that the bail order which is annexed to this bail application is dated 19.05.2020 and while rejecting the earlier bail application of the petitioner in BLAPL No. 7479 of 2020 as per

// 2 // order dated 30.03.2021, the learned trial Court was directed to expedite the trial and if possible, to conclude the same within a period of six months from the date of framing of charge and the petitioner was given liberty to renew the prayer for bail if the trial is not concluded within the said period. It is stated that the petitioner has not moved the learned trial Court after rejection of the earlier bail application.

In that view of the matter, this bail application stands disposed of giving liberty to the petitioner to renew his prayer for bail in the learned trial Court.
