This matter is taken up through hybrid mode.

Heard Mr. M.R. Khatua, learned counsel for the petitioner and Mr. J.P. Patnaik, learned Government Advocate for the state. 3.

The sole contention of the petitioner before this court was that pursuant to notice of eviction issued, the petitioner has filed his objection, the same has not been taken into consideration by the Tahasildar, Kujang. Accordingly, this Court vide order dated 26.09.2022 called upon the State Counsel to obtain instruction as to why the objection filed by the petitioner has not been taken into consideration by the Tahasildar, Kujang. 4.

With reference to the same, an affidavit is filed in Court today serving a copy thereof on learned counsel for the petitioner. In the said affidavit the order of the Additional Tahasildar, Kujang dated 17.08.2022 has been annexed, which indicates that the objection filed by the petitioner has been taken into consideration and the order has been passed thereof. The affidavit be kept on record.

In view of the above, this court is not inclined to entertain the prayer made by the petitioner in this writ petition. However, the petitioner is at liberty to pursue his remedy before the appropriate authority in accordance with law.
