Heard Mr. A. Sanganeria, learned Counsel appearing for the Petitioner and Mr. P.K. Muduli, learned Additional Government Advocate appearing for the State Opposite Parties. 3.
Mr. P.K. Muduli, learned Additional Government Advocate states that he has received instructions and contended that as per Letter No.27076 dated 10.09.2019 of Revenue & Disaster Management Deptt., Govt. of Odisha, in case of executants fail to produce transit pass and money receipt in support of payment of Royalty, the Public Works Authority shall deduct the royalty and cost of minerals and remit it to the Government Account. But the said letter has been withdrawn vide Letter No.37091 dated
// 2 // 26.11.2019 of the Revenue & Disaster Management Department, Govt. of Odisha. Therefore, the deduction made towards cost of materials from the running bill of the Petitioner has been refunded after withdrawal of the Letter by the Revenue and Disaster Management Deptt. Govt. of Odisha.

In view of that, nothing remains to be considered in this writ petition. Accordingly, the Writ Petition stands disposed of. ...........................
