Heard learned counsel for the Parties.

Impugned order was passed way back on 03.08.2009 involving a proceeding under Section 32 of OSS Act. Undisputedly the vendor of the Petitioner had contested the proceeding. In the meantime it appears vendor has no interest in pursuing the litigation. For the Settled position of law involving subsequent purchaser i.e. vendee is to simply enters into the shoe of the vendor, this Court finds, there is no scope to entertain the Writ Petition at the instance of third party and that too after such long delay.

The Writ Petition thus stands dismissed.
