Heard learned counsel for the Petitioner and the learned counsel for the State.

This is an application under section 439 Cr.P.C. filed by the Petitioner for bail in connection with Soro P.S.Case No.299 of 2021 corresponding to C.T.Case No.649 of 2021 pending in the Court of the learned J.M.F.C., Soro for alleged commission of offences under Sections 498(A), 304(B), 302/34 of the Indian Penal Code read with Section 4 of the Dowry Prohibition Act.

Perused the case diary, statements of the witnesses recorded under Section 161 Cr.P.C. and the F.I.R.

After hearing the parties and upon perusal of the Case Diary, P.M. Report and the statements of the witnesses recorded during investigation by the Police and taking into consideration the fact that the petitioner is languishing in jail custody since 09th August, 2021, I
// 2 // am inclined to release the Petitioner on bail in the aforesaid case on furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with one solvent surety for the like amount to the satisfaction of the learned court in seisin over the matter. Further the petitioner's release shall be subject to the condition that he shall not misuse his liberty granted to him in any manner whatsoever, shall cooperate with the investigation of the case and he shall not tamper with the evidence or threaten the prosecution witnesses. It is open for the Court in seisin over the matter to fix any other condition which may be deemed fit and proper in the facts and circumstances of the present case. 5.
The bail application stands disposed of.
