Heard learned counsel for the petitioners and learned Standing Counsel for the State.

Instant petition under Section 482 Cr.P.C. is filed assailing the impugned order under Annexure-1 whereby the learned court below issued NBWAs against the petitioners in connection with S.T. Case No.40/92 of 2020/2018 pending in the file of learned SR. C.J.- cum-Assistant Sessions Judge (WC), Nayagarh on the grounds stated therein.

Perused the impugned order dated 22nd July, 2022 as at Annexure-1.

The learned counsel for the petitioners submits that the petitioners were on bail but on the date fixed, an application under Section 317(1) Cr.P.C. was rejected and thereafter, NBWAs were issued against them and in facts and circumstances of the case, it is prayed that the petitioners should be directed to surrender and go on bail which the Court is inclined to.

Accordingly, it is ordered.

In the result, the CRLMC stands disposed of with a direction to the petitioners to surrender before the learned SR. C.J.-cumAssistant Sessions Judge (WC), Nayagarh on or before 20th October, 2022 in S.T. Case No.40/92 of 2020/2018 and in the event of their surrender, the court shall release them on bail with conditions as deemed just and proper in the facts and circumstances of the case. 7.

An urgent certified copy of this order be granted as per rules.
