This matter is taken up through Hybrid mode.

The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for quashing of the order dated 06.04.2021 passed by the learned Civil Judge (Jr.Division)-cum-JMFC, Rourkela in 1.C.C. No.265 of 2019 directing the petitioner to pay 20% of the cheque amount to the opposite party no.2-complainant within a period of sixty days from the date of order. 3.

Heard the learned counsel for the petitioner. 4.

Considering the facts and submission made, I see no illegality and infirmity in the impugned order.

However, on deposit the amount as ordered in the impugned order, the Court in seisin over the matter shall proceed with the trial of the aforesaid case and dispose of the same as expeditiously as possible preferably within a period of three months of receipt of the certified copy of this order. It is made clear that the amount so deposited by the petitioner as per the direction passed in the impugned order, shall not be disbursed to the opposite party no.2-complainant till dispose of the aforesaid case.

With the aforesaid order, this CRLMC stands disposed of being dismissed.
