This matter is taken up through Hybrid Mode.

Order No 2.

Heard Mr. K.C.Pradhan, learned counsel appearing for the Petitioner and Mr. Ch. S. Mishra, learned Addl. Government Advocate for the State-Opposite Parties. 3.

The Petitioner has filed the present Writ Petition with the following prayer:- "(i) To direct the Opp. Parties to consider the case of the petitioner and to pass an order of his employment against Class-III post.

(ii) To direct the Opp. Parties to appoint the petitioner under Rehabilitation Assistance Scheme in accordance with the decision of the Hon'ble Supreme Court.

(iii) To direct the Opp. Parties to give compassionate appointment to the petitioner within a stipulated period".

Learned counsel for the Petitioner submitted that on the death of the deceased employee on 22.06.2016, the Petitioner though made an application for his appointment under the provisions of Rehabilitation Assistance Scheme,

// 2 // but till date no final decision has been taken by the authority concerned.

Mr. Pradhan brought to the notice of this Court the communication issued in this regard vide Annexures-5 and 6.

Since the application in question was made on 03.01.2017 and documents annexed to the Writ Petition shows that the process for such consideration has been taken up by the Opposite Parties, this Court while disposing the Writ Petition directs the Opposite Party No.3 to take a final decision on the claim of the Petitioner within a period of three months from the date of receipt of this order.

With the aforesaid observations and directions, the Writ Petition stands disposed of.
