Heard Mr. Panda, learned counsel appearing on behalf of learned counsel for the petitioner and Mr. S.S. Kanungo, learned Additional Government Advocate for the State.

The petitioner has filed this writ petition seeking direction to the opposite parties to allow further six months' time before eviction/demolition of the dwelling house of the petitioner, which is situated over Khata No. 229, Plot No. 1426, Mouza-Commissioner Colony, Dhanupali, Sambalpur. 4.

Learned Counsel for the petitioner contended that against the notice of eviction, the petitioner has already moved the Collector for grant of time. 5.

Fact remains since notice of eviction has been issued by the Additional Tahasildar, Sambalpur, the petitioner had to approach the said authority instead of approaching the higher authority. However, on the prayer made by learned counsel for the petitioner, the petitioner is permitted to approach the appropriate authority, who shall consider the same and pass appropriate order in accordance with law.
