This is an application under Section 439 Cr.P.C. filed by the Petitioner for bail in connection with Gangapur P.S. Case No.206 of 2021, corresponding to G.R. Case No.558 of 2021, pending in the file of learned J.M.F.C., Aska, for commission of alleged offences under Sections 498-A/304-B/302/201/34 I.P.C. read with Section 4 of D.P. Act.

Heard learned counsel for the Petitioner and Mr. P.C. Das, learned Additional Standing Counsel for State. 3.

Learned counsel for the Petitioner submits that Petitioner is in jail custody since 22.5.2021. It is further submitted that chargesheet has been submitted in the meantime. 4.

Considering the nature of allegations and the fact that Petitioner is in jail custody since the date of her arrest, i.e. from 22.02.2021, I am inclined to release the Petitioner on bail in the

// 2 // above case on furnishing a bail bond of Rs.50,000/- (Rupees Fifty thousand) with one solvent surety for the like amount to the satisfaction of the learned court in seisin of the matter subject to conditions that the Petitioner shall cooperate in the investigation and shall not tamper with the evidence in any manner whatsoever. Further, it is open to the court in seisin of the matter to impose any additional condition(s), if situation so warrants. 5.

With the above direction, the BLAPL is accordingly allowed.
