This matter is taken up through hybrid mode.

The CMP has been filed assailing the order dated 29th November, 2021 (Annexure-10) passed by learned Senior Civil Judge, Nuapada in C.S. No.83 of 2016, whereby an application for acceptance of written statement by the Defendant No.5 has been rejected.

In course of hearing, Mr. Mishra, learned Counsel for the Defendant No.5-Petitioner submits that admittedly, the petition for acceptance of written statement was not properly drafted and suitably worded. Hence, he submits that interest of justice will be best served, if the Defendant No.5-Petitioner is granted liberty to file a fresh one for acceptance of her written statement stating the grounds in detail.

In view of such submission, this Court without expressing any opinion on the merits of the case of the

// 2 // Petitioner, disposes of the CMP with a direction that in the event, the Petitioner files a fresh application with better particulars for acceptance of her written statement within a period of two weeks hence along with certified copy of this order, the same shall be considered on its own merits without being influenced by the impugned order under Annexure-10. Urgent certified copy of this order be granted on proper application.
