This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.317 of 2022 pending in the file of learned S.D.J.M., Gunupur, arising out of Gunupur P.S Case No.159 of 2022, for offence under Sections 370A(2)/109 IPC and Sections 3/4/5/6/7 of the Immoral Traffic (Prevention) Act and is in custody since 27.08.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Gunupur by order dated 17.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the nature of allegation and the punishment prescribed and the period of custody since 27.08.2022, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 7.

Accordingly, the BLAPL stands disposed of.
