CORAM:
JUSTICE BISWANATH RATH Order No.
ORDER
29.09.2022 1.
Heard learned counsel appearing for the parties. 2.
It appears, the Petitioners have not raised any objection as of now involving the notice at Annexure-2. Considering the allegation of the Petitioners that there is steep hike in the Municipal Tax involving the property involved herein, for the opinion of this Court, unless the Competent Authority takes a decision on the objection of the Petitioners, High Court does not get into action.
3. Keeping this in view, this Court permits the Petitioners to raise objection involving Annexure-2 at least within two weeks of this order along with deposit of 50% of the arrear. In such event, there shall be a lawful decision on the objection of the Petitioners involving demand at Annexure-2 at least within three months. Till a decision is taken by the Competent Authority, there shall be no coercive action involving the Petitioners vis-à-vis the impugned order.
4. The Writ Petition stands disposed of accordingly. (Biswanath Rath) Judge sks
