Heard learned counsel for the petitioner and learned counsel Order No.

for the State.

Without pressing the petitioner on merits, learned counsel for the petitioner submits that the learned court below since issued NBWA under the impugned order i.e. Annexure-3, a direction should be issued for him to surrender in connection with G.R.Case No. 145 of 2013 and that would serve the purpose and meet the ends of justice. 3.

Mr. Praharaj, learned counsel for the State submits that the petitioner may be having criminal antecedent, in response to the above, learned counsel for the petitioner submits that he is involved in one more case registered under Section 498-A IPC which is at the behest of his wife.

Considering the above submission though the Court is not inclined to interfere with the impugned order of cognizance copy of which is at Annexure-3 is of the view that the petitioner who does not

have any criminal antecedent of similar nature should be directed to surrender before the court below and go on bail subject to conditions. 5.

Accordingly, it is ordered.

In the result, the CRLMC stands disposed of with a direction to the petitioner to surrender before the court of learned J.M.F.C., Ranpur on or before 20th October, 2022 in connection with G.R. Case No. 145 of 2013 corresponding to Ranpur P.S. Case No. 145(8) of 2013 and in the event of his surrender, the court below shall release him on bail with conditions and subject to confirmation that he does not have any criminal antecedent involving offences of the present kind.
