This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in G.R. Case No.578 of 2022 pending in the file of learned J.M.F.C., Barbil, arising out of Joda P.S Case No.204 of 2022, for offence under Sections 363/366 IPC and is in custody since 28.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Judge, Champua by order dated 05.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the statement of the victim recorded under Section 164 Cr.P.C., which is produced by the learned counsel for the State.

Considering the same and taking into account the substantial progress of the investigation and the nature of allegation qua the Petitioner, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
