This matter is taken up through hybrid Order No.

arrangement (virtual/physical mode).

Mr. L. Samantaray states that the directions of this Court contained in the order dated 6th April, 2021 passed in W.P.(C) No.4095 of 2021 have been duly complied with. In support, he has referred to Para 5 of the compliance affidavit dated 27.04.2022 filed by Opposite Party No.2 which reads as under:

"5. That it is pertinent to mention here that on 30.09.2021, the pucca market complex comprising with seven rooms has been evicted/demolished completely which was constructed over Plot No.36, Khata No.86 (Sarbasadharan), Kisam-Rasta under mouza Alarpur in presence of Tahasildar, Khaira, the O.P No.4, the Tahasildar, Simulia deployed as Executive Magistrate, IIC, Simulia PS, one platoon of police force for maintenance of law & order situation & to avoid any untoward incident during

// 2 // conduct of eviction process and the officials of revenue/fire/electricity & general public. Now, the said case land is free of encroachment to move the general public used as rasta.

Copy of Photocopy of eviction of unauthorized construction on the said case land is annexed herewith and marked as Annexure-B/2 for kind perusal of the Hon'ble Court.

In obedience to the order of Hon'ble High Court and following the observation made by the Hon'ble Court, the implementation of order has been made completely evicting/demolishing the illegal construction over the case land on 30.09.2021 with due regards to the order of the Hon'ble High Court."

In view of the above, the CONTC is disposed of as infructuous.
